Religious Freedom Facts

Constitutional protections and international human rights standards for religious freedom are important guidelines that ensure individuals have the right to practice their religion or belief without discrimination or interference. Here are some key points:

Universal Declaration of Human Rights: Article 18 of the Universal Declaration of Human Rights guarantees freedom of religion or belief. It emphasizes the right to freely change one's religion or belief and to manifest it in teaching, practice, worship, and observance.


International Covenant on Civil and Political Rights (ICCPR): Article 18 of the ICCPR also protects freedom of religion or belief. It prohibits discrimination based on religion or belief and guarantees equal protection. Limitations on religious freedom must be in line with the principles of non-discrimination and equal protection.


Declaration on the Elimination of All Forms of Intolerance of Discrimination Based on Religion or Belief: This declaration further emphasizes the importance of eliminating intolerance and discrimination based on religion or belief. It calls for the protection of individuals' rights to practice their religion or belief freely.


Constitutional Protections: Many countries have constitutional provisions that protect religious freedom. For example, the First Amendment of the United States Bill of Rights prohibits the establishment of religion and protects the free exercise of religion.

 

Prohibition of Discrimination: International standards emphasize that measures restricting government service eligibility, economic privileges, or imposing special restrictions on the practice of other faiths are not in accordance with the prohibition of discrimination based on religion or belief.


Limitations on Religious Freedom: While religious freedom is protected, limitations may be imposed if necessary to protect public safety, order, health, morals, or the fundamental rights and freedoms of others. However, these limitations must be necessary and proportionate to the purpose they serve.

Understanding these guidelines helps individuals assess whether restrictions on religious freedom are lawful and justifiable. By advocating for their rights within the framework of these standards, SJSP members can engage in peaceful protests that promote religious freedom and contribute to positive change.
